What is FIDUCIARY CAPACITY?

This applies to a person serving to handle money and property to benefit another party, such as the attorney, broker, guardian etc.

 TLD Example: The executor of the estate served in a fiduciary capacity and owed a duty to act in good faith in carrying the wishes of the deceased.
